Terms & Conditions
These terms and conditions and the booking details provided constitute the entire agreement concerning the provision of Taxi services (“Service”) between you and Ryedale’s Comfy Cars & Taxis. Completion of the booking form, booking by phone or via our APP and/or use of the Service indicates your unconditional acceptance of the terms and conditions set out in this Agreement.
“Ryedale’s Comfy Cars & Taxis”, “Us” & “We” means Ryedale’s Comfy Cars & Taxis who’s operator’s license to operate Private Hire Vehicles is provided by Ryedale District Council and registered to Rural Chauffeur LTD, Taxi HQ, Black Swan Yard, Helmsley, North Yorkshire, YO62 5ES. “you” and “your” means any individual, company or other business who places a booking or requests a quote for a journey with us.
2.1 It is your responsibility to allow sufficient time when booking your taxi to allow for the check-in times required by your airline, Train Station or Restaurant and for any delays caused by traffic conditions. We shall not be responsible for any delay caused by your failure to allow enough time to reach your destination or if the passengers are not ready for collection at the booked time.
2.2 You must order a suitable car size for the number of passengers and luggage. We cannot guarantee to carry excessive amounts of luggage.
2.3 A child, no matter what age, counts as one passenger.
2.4 If you need to transport a wheelchair please specify this at the time of booking so that we can provide a vehicle with sufficient stowage capacity.
2.5 We currently cannot accept bookings where passengers need to travel in their wheelchair.
3. Prices & Payments
3.1 Ryedale’s Comfy Cars & Taxis will give you a quotation based on the information supplied by you.
3.2 Ryedale’s Comfy Cars & Taxis may amend the quotation if there is any material change to the original itinerary such as the number of passengers or the type or size of vehicle required.
3.2 The quotation will include a  minute waiting period and the cost of car parking where required.
3.3 Ryedale’s Comfy Cars & Taxis will charge for waiting at its standard rates after the initial 5-minute period has expired.
3.4 Ryedale’s Comfy Cars & Taxis will endeavor to check for flight and train delays before the driver leaves for an airport, port or train station but shall be under no obligation to do so.
3.5 If you accept the quotation, you will receive confirmation of your booking by email (providing you have supplied your email address). Please check your booking confirmation carefully and inform Us of any errors.
3.6 Ryedale’s Comfy Cars & Taxis shall not be responsible for any delays caused or costs arising from your failure to provide Us with correct information.
3.7 All journeys are to be paid for at the time of booking, this is non refundable should you decide to cancel. The only exceptions to this are Hotels, Restaurants booking on behalf of passengers and Credit Accounts.
3.8 Payment can be made by credit card, debit card, bacs or cash.
3.9 Ryedale District Council may vary the taxi pricing and structure from time to time, our rates will be amended to reflect any changes made.

3.11 If you want to make a TT or Bacs payment please ask us for the bank details.
3.12 We do not accept cheques under any circumstances.
3.13 We can accept payments by card in the vehicles as well as over the phone.
3.14 We do accept AMEX (American Express) and pretty much any other card.
3.15 Any attempt at non-payment will be reported to the police in the area where the vehicle is at the time.
4. The Service
4.1 You shall be responsible for the behavior of all the passengers in the vehicle during the journey.
4.2 You will be charged £100 to cover cleaning costs in the event of the vehicle being soiled in any way during the journey.
4.3 Smoking in any form and/or the use of E Cigarettes/Vaping is not permitted.
4.4 Eating and drinking is not permitted, except at the expressed permission of the driver.
4.5 All children travelling during the journey should be restrained in a manner appropriate to their age, weight and height.
4.6 Suitable child seats should wherever possible be supplied and fitted by the child’s parents.
4.7 Such seats may be retained by the driver for use on the return journey.
4.8 Ryedale’s Comfy Cars & Taxis vehicles will not carry more passengers than its insurance or licensing allows.
4.9 Ryedale’s Comfy Cars & Taxis will carry Assistance dogs for no additional charge in accordance with the Equality Act 2010, which states: the Equality Act 2010 Section 168 states that, drivers have a duty to convey the disabled passenger`s dog and allow it to remain with the passenger; and not make any additional charge for doing so.
4.10 We now allow pets to be transported but only when they are prebooked, other than Assistance Dogs that are always wecome! in accordance with the Equality Act 2010, section 168 as noted in section (4.9)
4.11 Any nuisance passengers or damage caused will be reported to the police in the area where the vehicle is at time.
5. Cancellations & Refunds
5.1 Any Journey cancelled or aborted for any reason that is outside of our control within will be charged in full and no refund will be given where a deposit has been taken and any difference will be payable with immediate effect.
5.2 Ryedale’s Comfy Cars & Taxis will refund any deposit if we have to cancel a booking for a reason that is within our control,
5.3 Any refunds made in respect of payments made by card, will be made back to the card that payment was made form.
5.4 We will never make a refund by cheque or cash.
6.1 Ryedale’s Comfy Cars & Taxis shall use all reasonable endeavors to get you to your destination on time, but shall not be liable for any loss due to delays caused by road or traffic conditions beyond our control on the journey.
6.2 Under no circumstances shall Ryedale’s Comfy Cars & Taxis be liable (in contract, tort or otherwise) for any loss of profits, business or for any indirect or consequential loss whatever.
6.3 All luggage is carried entirely at your risk.
6.4 Ryedale’s Comfy Cars & Taxis shall be entitled to cancel all services and provide proportionate refunds in the event of a declared national emergency, riot, war, fuel shortage, extreme weather or terrorist attack, or other circumstances beyond its c control. If the car breaks down during your journey We will endeavor to arrange an alternative car to complete the journey as soon as practicable.
6.5 You shall indemnify Ryedale’s Comfy Cars & Taxis against all losses, costs, damages and expenses arising from any act or omission of any passenger in your party.
6.6 Neither party excludes or limits its liability for death or personal injury caused by negligence, or for willful default or fraudulent misrepresentation, or otherwise in any manner unenforceable by any applicable law.
Ryedale’s Comfy Cars & Taxis will refuse or terminate any booking with immediate effect if it places any driver or vehicle at risk of any damage, violence or abuse by you or by any passenger in your party and we will ask all passengers to vacate the vehicle as soon as it is safe to do so. The Police will be called immediately in the area where the vehicle is at the time. No refunds will be given if the journey is terminated part way through the hire.
8.1 Ryedale’s Comfy Cars & Taxis may subcontract its obligations under this Agreement.
8.2 You shall not assign, transfer or delegate any of your rights or obligations under this Agreement.
8.3 Ryedale’s Comfy Cars & Taxis may change these terms and conditions at any time by posting changes online. Please review these terms and conditions regularly to ensure that you are aware of any changes. All existing bookings will be at the rate quoted or applicable rate in effect at the time of booking.
8.5 This Agreement and any accompanying quotation represents the entire agreement between you and Ryedale’s Comfy Cars & Taxis in relation to its subject matter. If there is any discrepancy between the terms of this Agreement and the quotation, the terms of this Agreement shall prevail.
8.6 Nothing in this Agreement is intended to confer any benefit on any third party, whether pursuant to the Contracts (Rights of Third Parties) Act 1999 or otherwise, and no third party shall have the right to enforce any rights under this Agreement except where otherwise agreed in writing.
8.7 All calls to Ryedale’s Comfy Cars & Taxis are recorded.
This Agreement shall be construed in accordance with English law and you and Ryedale’s Comfy Cars & Taxis each agree to submit to the exclusive jurisdiction of the English Courts in respect of any dispute or claim arising out of or in connection with this Agreement.
10. Conveying of children
UK law states that taxis are exempt from legislation relating to children travelling in a baby/child seat or booster. For Health and Safety reasons Ryedale’s Comfy Cars & Taxis are unable to provide any form of child seat. If you require a child seat for your journey it would be the child’s parent/carers responsibility to provide one and to fit the seat in the vehicle and to secure the child. If you are booking a return journey and have your own child seat, the driver who carries out your booking will store your child seat for the return journey, please note that the installation of the child seat must be carried out by you.
