Terms & Conditions

These terms and conditions and the booking details provided constitute the entire agreement  concerning the provision of Taxi services (“Service”) between you and Rural Chauffeur LTD T/A Ryedale’s Comfy Cars & Taxis.  Completion of the booking form, booking by phone or via our APP and/or use of the Service indicates your unconditional acceptance of the terms and conditions set out in this Agreement.

 1.     Definitions
“Ryedales Comfy Cars & Taxis”, “Us” & “We” means Rural Chauffeur LTD (11581005) T/A Ryedale’s Comfy Cars & Taxis whos operator’s license to operate Private Hire Vehicles is provided by Ryedale District Council and registered to Rural Chauffeur LTD, Black Swan Yard, Helmsley, North Yorkshire, YO62 5BJ. “you” and “your” means any individual, company or other business who places a booking or requests a quote for a journey with us.

 2.     Booking
2.1  It is your responsibility to  allow sufficient time when booking your taxi to allow for the check-in times required by your airline, Train Station or Restaurant and for any delays caused by traffic conditions.  We shall not be responsible for any delay caused by your failure to allow enough time to reach your destination or if the passengers are not ready for collection at the booked time.

2.2  You must order a suitable car size for the number of passengers and luggage.  We  cannot guarantee to carry excessive amounts of luggage.

2.3  A child, no matter what age, counts as one passenger.

2.4  If you need to transport a wheelchair please specify this at the time of booking so that we can provide a vehicle with sufficient stowage capacity.

2.5 We currently cannot accept bookings where passengers need to travel in their wheelchair.

3.    Prices & Payments
3.1  Ryedale’s Comfy Cars & Taxis will give you a quotation based on the information supplied by you.

3.2  Ryedale’s Comfy Cars & Taxis may amend the quotation if there is any material change to the original itinerary, the number of passengers,  or the type or size of vehicle required.

3.2  The quotation will include a [5] minute waiting period and the cost of car parking where required.

3.3  We are registered with HMRC in the UK for VAT, all of our services are Vatable at 20%.

3.4  Ryedale’s Comfy Cars & Taxis will charge for waiting at its standard rates after the initial 5-minute period has expired.

3.5  Ryedale’s Comfy Cars & Taxis will endeavor to check for flight and train delays before the driver leaves for an airport, port or train station but shall be under no obligation to do so.

3.6  If you accept the quotation, you will receive confirmation of your booking by email (providing you have supplied your email address). Please check your booking confirmation carefully and inform Us of any errors.

3.7  Ryedale’s Comfy Cars & Taxis shall not be responsible for any delays caused or costs arising from your failure to provide Us with correct information.

3.8  All journeys are to be paid for at the time of booking, this is non refundable should you decide to cancel.  The only exceptions to this are Hotels, Restaurants booking on behalf of passengers and Credit Accounts.

3.9  Payment can be made by credit card, debit card, Bacs or cash.

3.10  Ryedale District Council may vary the taxi pricing and structure from time to time, our taxi rates will be amended to reflect any changes made.

this payment gateway is integrated into our system and will update your booking as paid and with the amount paid.

3.12  If you want to make a TT or Bacs payment please make it to the following account… Sort Code 07-04-36, Account 24705065 & use your booking reference for the payment so that it is allocated to the correct journey.

3.13  We do not accept cheques.

3.14  We can accept payments by card in the vehicles.

3.15  We do accept AMEX (American Express)

3.16  Any attempt at non-payment will be reported to the police in the area where the vehicle is at the time.

4.     The Service
4.1  You shall be responsible for the behaviour of all the passengers in the vehicle during the journey.

4.2  You will be charged £100 to cover cleaning costs in the event of the vehicle being soiled in any way during the journey.

4.3  Smoking in any form and/or the use of E Cigarettes/Vaping is not permitted.

4.4  Eating and drinking is not permitted, except at the expressed permission of the driver.

4.5  All children travelling during the journey should be restrained in a manner appropriate to their age, weight and height.

4.6  Suitable child seats should wherever possible be supplied and fitted by the child’s parents.

4.7  Such seats may be retained by the driver for use on the return journey.

4.8  Ryedale’s Comfy Cars & Taxis vehicles will not carry more passengers than its insurance or licensing allows.

4.9  Ryedale’s Comfy Cars & Taxis will carry Assistance dogs for no additional charge,

4.10  Pets other than Assistance Dogs are carried at the discretion of Ryedale’s Comfy Cars & Taxis. (also see 4.2)

4.11  Any nuisance passengers or damage caused will be reported to the police in the area where the vehicle is at time.

5.     Cancelations & Refunds
5.1  Any Journey cancelled or aborted for any reason that is outside of our control within 24 hours of the agreed pickup time will be charged in full and no refund will be given where a deposit has been taken and any difference will be payable with immediate effect.

5.2  Any Journey cancelled or aborted for any reason that is outside of our control between 48 hours and 24 hours before the pickup time will be charged at 50%.  Any return on deposit will be calculated on the basis of us retaining 50% of the originally quoted fare and any shortfall will become payable with immediate effect.

5.3  For cancelations for any reason outside of our control between 48 Hours and 1 Week will be charged at 25%, any return on deposit will be calculated on the basis of us retaining 25% of the originally quoted fare and any shortfall will become payable with immediate effect.

5.4  Ryedale’s Comfy Cars & Taxis will refund any deposit if we have to cancel a booking for a reason that is within our control,

5.5  Any refunds made in respect of payments made by card, will be made back to the card that payment was made form.

5.6  We will never make a refund by cheque or cash.

5.7  Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you are contracting with us as a consumer, online, by phone, at a wedding fair or any other venue other than our office you have the right to cancel your contract at any time up to 14 calendar days after the day on which you ordered our services. Should you wish to cancel your order you must do so by letter to: Old Station Cottage, Station Road, Helmsley, YO62 5BZ quoting your reference number.

​6.     Liability
6.1  Ryedale’s Comfy Cars & Taxis shall use all reasonable endeavours to get you to your destination on time, but shall not be liable for any loss due to delays caused by road or traffic conditions beyond our control on the journey.

6.2  Under no circumstances shall Ryedale’s Comfy Cars & Taxis be liable (in contract, tort or otherwise) for any loss of profits, business or for any indirect or consequential loss whatever.

6.3  All luggage is carried entirely at your risk.

6.4  Ryedale’s Comfy Cars & Taxis shall be entitled to cancel all services and provide proportionate refunds in the event of a declared national emergency, riot, war, fuel shortage, extreme weather or terrorist attack, or other circumstances beyond its c control. If the car breaks down during your journey We will endeavour to arrange an alternative car to complete the journey as soon as practicable.

6.5  You shall indemnify Ryedale’s Comfy Cars & Taxis against all losses, costs, damages and expenses arising from any act or omission of any passenger in your party.

6.6  Neither party excludes or limits its liability for death or personal injury caused by negligence, or for willful default or fraudulent misrepresentation, or otherwise in any manner unenforceable by any applicable law.

7.     Termination
Ryedale’s Comfy Cars & Taxis will refuse or terminate any booking with immediate effect if it places any driver or vehicle at risk of any damage, violence or abuse by you or by any passenger in your party and we will ask all passengers to vacate the vehicle as soon as it is safe to do so.  The Police will be called immediately in the area where the vehicle is at the time.  No refunds will be given if the journey is terminated part way through the hire.

8.     Miscellaneous
8.1  Ryedale’s Comfy Cars & Taxis may subcontract its obligations under this Agreement.

8.2  You shall not assign, transfer or delegate any of your rights or obligations under this Agreement.

8.3  Ryedale’s Comfy Cars & Taxis may change these terms and conditions at any time by posting changes online.  Please review these terms and conditions regularly to ensure that you are aware of any changes. All existing bookings will be at the rate quoted or applicable rate in effect at the time of booking.

8.4  Ryedale’s Comfy Cars & Taxis shall store, process and use all information regarding your personal details in  accordance with the requirements of the Data Protection Act 1998. (Privacy Policy & Data Protection)

8.5  This Agreement and any accompanying quotation represents the entire agreement between you and Ryedale’s Comfy Cars & Taxis in relation to its subject matter.  If there is any discrepancy between the terms of this Agreement and the quotation, the terms of this Agreement shall prevail.

8.6  Nothing in this Agreement is intended to confer any benefit on any third party, whether pursuant to the Contracts (Rights of Third Parties) Act 1999 or otherwise, and no third party shall have the right to enforce any rights under this Agreement except where otherwise agreed in writing.

8.7  All calls to Ryedale’s Comfy Cars & Taxis are recorded.

9.     Disputes
This Agreement shall be construed in accordance with English law and you and Ryedale’s Comfy Cars & Taxis each agree to submit to the exclusive jurisdiction of the English Courts in respect of any dispute or claim arising out of or in connection with this Agreement.

10.     Conveying of children
UK law states that taxis are exempt from legislation relating to children travelling in a baby/child seat or booster.  For Health and Safety reasons Ryedale’s Comfy Cars & Taxis are unable to provide any form of child seat. If you require a child seat for your journey it would be the child’s parent/carers responsibility to provide one and to fit the seat in the vehicle and to secure the child. If you are booking a return journey and have your own child seat, the driver who carries out your booking will store your child seat for the return journey, please note that the installation of the child seat must be carried out by you.
